REACH規則の附属書XVII制限リストEntry 50. PAHsに制限条件を追加

2021年07月21日、EUにおける一般・工業用化学品の基本法令であるREACH規則の附属書XVIIを改正する規則 (EU) 2021/1199が公布されました。施行日は2021年08月10日ですが、附属書XVII制限リストに関係する改正の場合は、要件個別の遵守期限を確認する必要があります。

制限条件が追加された背景は？

まず規制対象であるPolycyclic-aromatic hydrocarbons (PAH)は、多環芳香族炭化水素と呼ばれ、2009年から既にREACH規則附属書XVIIのエントリー50に収載され、制限条件1項から4項までの内容が盛り込まれていました。当初の焦点は主にエクステンダーオイルや自動車のタイヤおよびタイヤの部品にありました。指定の閾値を超えて含むそれらの上市や製造での使用を禁止する内容でした。

今回、制限条件の追加の背景には、新たな用途への関心があります。今回、制限条件の追加の焦点となっているのは、人工芝のピッチの充填剤（infill）として使用されるゴム顆粒（Rubber granules）やマルチ材（mulches）です。運動場やゴルフ場、競技場、競馬場、自然観察路、射撃場などのスポーツ施設では、ゴム顆粒やマルチ材がバラの状態で使用されています。これらのゴム顆粒やマルチ材は、主に使用済みタイヤ（ELT）を原料としています。8種類のPAHsは、発がん性の有害性に分類されていることから、ゴム顆粒やマルチ材への使用が懸念されます。しかし、ゴム顆粒やマルチ材に含まれるPAHsは、従来の附属書XVIIエントリー50の制限条件では、規制対象にはなりませんでした。

対象物質

対象物質は次のように特定されています。

制限条件

遵守期限は各要件別、用途別の要件別に細かく規定されています。

9. Granules or mulches shall not be placed on the market for use as infill material in synthetic turf pitches or in loose form on playgrounds or in sport applications if they contain more than 20 mg/kg (0,002 % by weight) of the sum of all listed PAHs.

10. Granules or mulches shall not be used as infill material in synthetic turf pitches or in loose form on playgrounds or in sport applications if they contain more than 20 mg/kg (0,002 % by weight) of the sum of all listed PAHs.

11. Granules or mulches placed on the market for use as infill material in synthetic turf pitches or in loose form on playgrounds or in sport applications shall be marked with a unique identification number of the batch.

12. Paragraphs 9 to 11 shall apply from 10 August 2022.

13. Granules or mulches that are in use in the Union on 9 August 2022 as infill material in synthetic turf pitches or in loose form on playgrounds or in sport applications may remain in place and continue to be used there for the same purpose.

14. For the purposes of paragraphs 9 to 13:

(a) “granules” are mixtures that appear as solid particles in the size range from 1 to 4 mm, which are made from rubber or other vulcanised or polymeric material of recycled or virgin origin, or obtained from a natural source;

(b) “mulches” are mixtures that appear as flake-shaped solid particles in the size range from 4 to 130 mm length and 10 to 15 mm width, which are made from rubber or other vulcanised or polymeric material of recycled or virgin origin, or obtained from a natural source;

(c) “infill material in synthetic turf pitches” consists of granules used in synthetic turf pitches to improve the sport technical performance characteristics of the turf system;

(d) “use in loose form on playgrounds or in sport applications” is any use of granules or mulches in loose form on playgrounds or for sport purposes other than as infill material in synthetic turf pitches.’

対象物質の有害性

欧州における化学物質の分類・表示・包装の基本事項を規定するCLP規則では、調和分類表示（CLH）制度により、次のように対象物質の有害性区分を分類しています。いずれの物質も発がん性に分類されています。
