工芸品および工業製品の地理的表示保護はオンライン環境にも適用へ

2023年05月02日、EU理事会は、欧州議会との間で、工芸品および工業製品の地理的表示保護に関する規則案について暫定的な合意に達したことを明らかにしました。この規則案が最終的に承認されれば、これまで主に食品・飲料に用いられてきた地理的表示（GI）が、ボヘミアンガラス、リモージュ磁器、ゾーリンゲンカトラリーなど、生産地と品質が本質的に結びついている工業製品に拡大されることになる見込みです。

合意の概要

■　「保護された地理的表示（protected geographical indications）」（「PGI」）の概念を適用することにより、農産物の地理的表示保護規則との一貫性を保証する。これは、製品の特性と地理的原産地との間に強い関連性を維持する生産者にとって、地理的表示の魅力を保証するものである。

■　自己宣言に基づくシステムを通常の手続きとし、加盟国が管理体制を強化することで、地理的表示保護のための効率的な管理および検証手続きを提供する。

■　工芸品や産業用GIの保護が、ドメイン名空間やオンライン環境にも適用されることを保証する。

■　工芸・産業用GIの登録手続きにおいて、EU知的財産庁（EUIPO）が重要な役割を果たすことにより、高いレベルの法的保護を確保しつつ、特に中小企業にとってGIの登録手続きを容易にする。

暫定合意の内容は、欧州議会とEU理事会の双方で正式に採択される必要がある。

地理的表示（GI）

農産物や食品についてEUレベルで地理的表示を保護することは、何年も前から実施されていました。これは、EUの品質確保の政策の一環で、地理的な原産地や伝統的なノウハウと結びついた、特定の製品のユニークな特徴を促進するために、その製品名を保護することを目的とするものです。

製品名は、その製品が作られた場所と特定の関連性がある場合、「地理的表示」（geographical indication, GI）を付与することができるとされており、GIの認定により、消費者は高品質の製品を信頼し、区別することができ、また生産者は製品をより良く販売することができるようになる仕組みです。

GI認定を検討中または認定された製品は、GI登録簿に登録されます。登録簿には、各製品の地理的仕様や生産仕様に関する情報も記載されています。

また、地理的表示（GI）とは、生産地と品質が特に関連する特定の製品について、知的財産権を設定するものでもあります。

事例

PDOとPGIの違いは、主に製品の原材料がどれだけその地域で生産されているか、または生産工程がどれだけ特定の地域内で行われているかに関連しています。また、農産物に関するものもあります。

法案背景

欧州議会の議員たちは、2015年にすでに地元で製造された製品をEU全体で保護するよう求めており、2019年には、地元の非食品製品の国際的な承認を可能にするジュネーブ法へのEU加盟を受けて、あらためてその主張を行っていました。

概要

これまで、EUではワイン、蒸留酒、食品、その他の農産物を対象に、特定のGI保護規定を設けられていましたが、工芸品や工業製品については、現在、EU全域にわたるGI保護は存在しませんでした。

このような製品のGI保護は、職人や生産者、特に中小企業がEUの競争規則に則ってEUレベルで伝統的なノウハウを促進・保護することを支援し、工芸品への技術革新と投資の拡大につながるとしています。この規則案に関連して、EU知的財産庁（EUIPO）は、新しい保護制度の実施、特に工芸品および産業用GIの登録手続きにおいて重要な役割を果たすことになるとされています。
