米国の燃費規制、CAFE基準違反に係わる罰金を定める規則の見直しへ

2021年08月20日、米国の国家道路運輸安全局（NHTSA）は、同国の自動車燃費基準として知られるCAFE基準に違反した場合の罰則を定める規則を見直す内容について官報で公示し、意見募集を開始しました。意見募集は、2021年09月20日までとなっています。

経緯としては、2021年1月14日、NHTSAはAlliance for Automotive Innovationからの規則制定の要請に応えて、暫定最終規則（Interim final rule）を発表し、適用される企業平均燃費（CAFE）基準に違反した自動車メーカーに適用される民事罰のインフレ調整を、2022年式車両から適用することを規定していました。暫定最終規則では0.1 mile/gallon 違反あたり従来の$5.50から$14に引き上げる内容となっていました。その後に公布された大統領令およびNHTSAによる提出されたコメントの検討を踏まえ、NHTSAはこの暫定最終規則を見直し、再検討しています。

今回の見直しは大統領令E.O.13990「公衆衛生および環境保護ならびに気候危機に取り組むための科学の回復」を受けてのものであり、同大統領令に基づき運輸省長官はこのCAFE罰金額引き上げに関する暫定最終規則を見直すことを明らかにしていました。

即ち、今回の見直しの主旨は、次の論点となっています。

• 暫定最終規則を撤回して2016年12月の最終規則に戻し、2019年式の車両からCAFE民事罰率の引き上げの適用を元に戻す最終規則に進むべきかどうか
• インフレ調整を2019年式の車両よりも後の年式の車両から適用すべきかどうか

改正規則の対象箇所

PART 578—CIVIL AND CRIMINAL PENALTIES
§  578.6　Civil penalties for violations of specified provisions of Title 49 of the United States Code.

(h) * * *

(2) Except as provided in 49 U.S.C. 32912(c), beginning with model year 2019, a manufacturer that violates a standard prescribed for a model year under 49 U.S.C. 32902 is liable to the United States Government for a civil penalty of $14, plus any adjustments for inflation that occurred or may occur (for model years before model year 2019, the civil penalty is $5.50), multiplied by each .1 of a mile a gallon by which the applicable average fuel economy standard under that section exceeds the average fuel economy—

(i) Calculated under 49 U.S.C. 32904(a)(1)(A) or (B) for automobiles to which the standard applies produced by the manufacturer during the model year;

(ii) Multiplied by the number of those automobiles; and

(iii) Reduced by the credits available to the manufacturer under 49 U.S.C. 32903 for the model year.
