重要新規利用規則（SNUR）
2024年09月27日、米国の有害物質規制法（TSCA）の第5条に基づき、特定用途の化学物質を規制する重要新規利用規則（SNUR）（21-3.F）の草案が官報で公示され、10月28日まで意見募集期間が設けられています。

重要新規利用規則（SNUR）とは？
「重要新規利用規則」は”Significant New Use Regulation”の頭文字をとって「SNUR」という通称で知られています。その名の通り、特定の化学物質について懸念される用途を規制する制度で、有害物質規制法（TSCA）の第5条に基づいて物質ごとに、対象物質、関連定義、重要新規利用となる用途、その他要件がまとめられ、規則という形で公布されます。
根拠条項
第5条 重要新規利用用途の物質の製造・加工禁止
・EPA長官が重要新規利用であると特定した用途のために何らかの化学物質を製造又は加工してはならない。
第5条の禁止規定の適用免除：届出但し、次の要件を満たす場合、上記の禁止規定は適用されず、製造または加工を行うことができる。
・そのような製造または加工を行う90日前に、その者が（d）項（届出の内容）に従って当該物質の製造または加工を行う意図の届出を長官に提出する、且つ、
・（b）項（情報の提出）、（e）項（情報作成中の規制）または（f）項（不当なリスクに対する保護）の適用されるあらゆる要件またはそれら各項に従って課されるあらゆる要件を遵守する場合で、
・ EPA長官によって、届出の審査が実施されており、その届出の審査期間内に、決定に関連して要求される措置をとっている場合。※上記届出は重要新規利用届出（Significant New Use Notification, SNUN）とも呼ばれます。
届出にはEPAが指定する「EPA Form 7710-25」の様式を用いて提出する必要があるが、中央データ交換（CDX）システムを利用した電子的な提出も可能となっています。詳しくはEPAの案内ページを参照ください。
SNUR対象物質
SNUR対象物質は連邦規則集Title 40 Part 721 Subpart Eに組み込まれ、膨大な数の規制対象物質が収載されています。
重要新規利用とは？
重要新規利用とは何か、という点について、上記で物質毎に規則で特定されると記載しましたが、より具体的には、
①予め規則で重要新規利用になりうる行為が指定されており
②公布される物質毎のSNURにおいて、その規則で指定されている行為（重要新規利用）の中から、その物質についての重要新規利用が選定され、適用される、というのが基本的な構造となっています。
①予め指定されている重要新規利用 ⇒ 連邦規則集Title 40 Part 721 Subpart B Certain Significant New Uses
②SNURで特定される物質毎の重要新規利用 ⇒ SNURの各物質毎の規定の中で重要新規利用が特定される（（例）The significant new uses are:・・・）
「予め指定されている重要新規利用」には次のものがあります。
■ 作業場における保護プログラムを確立せずに行う、その物質の何らかの利用に関係のある製造、輸入又は加工のすべての方式又は方法 （§721.63）
■ 危険有害性周知プログラムを確立せずに行う、その物質の何らかの利用に関係のある製造、輸入又は加工のすべての方式又は方法 （§721.72）
■ 工業的、商業的及び消費者活動 （§721.80）
■ 処分（焼却、埋立、深井戸注入以外） （§721.85）
■ 水中への放出 （§721.90）
■ すべての利用（any use）
即ち、具体的に重要新規利用とはどういう行為かを知るためには、上記各規則の内容を細かく確認しなければなりません。
例えば、「工業的、商業的及び消費者活動 （§721.80）」には、(a)から(y)までの細かな重要新規利用の分類があり、多くの場合、実際に各物質に対する規則で適用されるのはそのうちの数項目です。
重要新規利用届出（SNUN）は必ず必要？
実は重要新規利用届出（SNUN）が免除されるケースが存在します。CFR 40 §721.5 Persons who must report.の(a)(2)で特定されているその免除事項は次の通りです。
Subpart Eで特定された化学物質を商業目的で製造、輸入または加工しようとする者で、その物質を商業的に流通させようとする者は、その者から物質を受け取る各受領者に関して、以下の1つ以上の文書を作成できる場合、重要な新規使用通知書を提出する必要はありません。
(i) 物質とその指定された重要新規利用を特定する本PartのSubpart Eの特定のセクション（※＝その物質に関するSNURのセクション）を、その者が書面で受領者に通知したこと。
(ii) 受領者が、その物質とその指定された重要新規利用を特定する本PartのSubpart Eの特定のセクションについて知っていること。
(iii) 受領者は、本PartのSubpart Eの特定のセクションに記載されている重要新規利用を行うことができないこと。
